1 General Terms and Conditions of Travel and Contract
These ‘General Terms and Conditions of Travel and Contract’ apply to all travellers who have booked their trip with Twende Tanzania Safari GmbH. They are part of the contract between you and (TTS) GmbH.
2 Conclusion of contract
2.1 The contract between you and TTS is concluded with the unconditional acceptance of your written, telephone or personal registration. From this point in time, the rights and obligations arising from the contract (including these ‘General Terms and Conditions’) become effective for you and TTS. If the person making the booking registers further travellers, they are responsible for their contractual obligations (in particular payment of the tour price) in the same way as for their own obligations. The contractual agreements and these ‘General Terms and Conditions’ apply to all tour participants.
2.2 When making your booking, you are obliged to state your name and the names of your fellow travellers as shown on the identity documents (passport, etc.) used for the trip. If the names on the travel documents do not match the names on the identity card, you may be refused the travel service or incur costs for the reissue of tickets. TTS cannot assume the costs incurred for this.
2.3 We would like to point out that our services are generally only valid from the airport in Tanzania. It is therefore your responsibility to arrive at the airport in Tanzania on time. TTS cannot accept any liability for changes made by the airlines (flight schedule, travel costs, etc.). TTS is also not a contractual partner for all other arrangements booked by the travellers themselves or directly.
2.4 If individual (ancillary) travel services from third-party providers (e.g. hotel, domestic airlines etc.) and/or travel arrangements from other tour operators or shipping companies are arranged for you by TTS, the respective travel and contractual conditions of the third-party providers apply.
3 Provisional reservations and bookings
3.1 TTS does not accept provisional reservations or bookings.
4 Terms of payment and price
4.1 Due date
The entire invoice amount must be paid when the definitive order is placed.
4.2 Price changes
In certain cases listed below, we reserve the right to adjust the prices quoted retrospectively, even after conclusion of the contract, in the event of
– changes in transport company tariffs (e.g. fuel surcharges)
– newly introduced or increased generally binding fees or charges (e.g. increased harbour or airport taxes or increased park entrance fees)
– government-imposed price increases (e.g. value added tax)
– extraordinary price increases by hotels
– plausibly explainable printing errors
– exchange rate changes
4.3 Exchange rates
The prices of the travel arrangements are calculated at the prices of the secondary providers valid at the time of booking
4.4 Cancellation
If TTS has to change the stated prices for the reasons mentioned above, you will be informed of this price increase at least 3 weeks before departure. If the price increase amounts to more than 10% of the originally booked package price, you have the right to withdraw from the contract within 5 days of receiving our notification. In this case, TTS will reimburse you in accordance with section 6.3.
5 Cancellation, change or non-cancellation by you
5.1 General information
In principle, cancellations or changes must be made in writing.
If the FDFA and/or the FOPH advise against travelling to a region you have booked, you may change your booking during a certain period. No cancellation fees are due, but processing fees and insurance premiums may be charged. TTS adheres exclusively to the travel advice issued by the FDFA or FOPH. If these authorities do not expressly advise against travelling to your booked country or region, the following conditions apply:
5.2 Processing fees
TTS charges a processing fee of CHF 100 per person for cancellations and changes (name changes, changes of travel date, rebooking of accommodation), up to a maximum of CHF 200 per order. Any telephone charges will be added. For boat trips, safaris and accompanied treks, additional shipping company and agency charges may apply. After the start of the cancellation periods, the conditions set out in section 5.3 also apply.
5.3 Cancellation/amendment costs
If you cancel the contract later than the following number of days before the start of your trip, we will charge the following costs as a percentage of the package price in addition to the processing fees in accordance with section 5.2:
– 90-45 days before departure 25%
– 45-30 days before departure 50%
– 30-0 days before departure incl. no-show 100%
5.4 Substitute person
If you are unable to travel, you can propose a replacement person for you under the following conditions. Please note, however, that we can only bindingly register your replacement person if all our travel partners still allow this change at the time of registration. The following points also apply:
– The replacement person is prepared to take over your travel arrangements under the same conditions that you have agreed with us.
– The other companies involved in your trip (hotels or air and shipping companies) accept this change, which can be difficult, especially in the high season.
– The replacement person fulfils the special travel requirements (passport, visa, vaccination requirements).
– There are no legal or official regulations preventing your substitute from taking part in the trip.
– This person and you are jointly and severally liable to us or the booking office for payment of the price and for any additional costs incurred as a result of this assignment.
5.5 Non-commencement of the journey
If a passenger does not start the journey arranged by TTS, the price of the journey must be paid in full in all cases and the obligation to provide transport is cancelled. This also applies to flight postponements. TTS recommends confirming the return flight to Switzerland 72 hours before departure with the relevant representative.
5.6 Joint and several liability
Participants in a TTS trip are jointly and severally liable for the total travel costs, regardless of who appears as the signatory in the
who is named as the signatory in the travel agreement or in the contract.
6 Programme changes, cancellation or non-performance of the tour by TTS
6.1 Unforeseen changes before the trip
If it is not possible to carry out a trip as promised or agreed with you, TTS will endeavour – without assuming any liability for its success – to find a substitute solution. This will be done in such a way that the objective purpose or character of the trip can be maintained as far as possible.
6.2 Unforeseen changes during the planning phase
TTS also reserves the right to change programmes or individual agreed services (e.g. accommodation, type of transport, aircraft type, airline, excursions) in your interest if unforeseen circumstances make this necessary. In the case of domestic flights organised by the company, TTS reserves the right to replace a named airline with another airline. The name of the new airline will be communicated to you as soon as possible. In rare cases, TTS may also be forced to cancel your trip for reasons beyond our control, whether for your safety or due to other compelling circumstances, such as non-issuance or withdrawal of landing rights, force majeure (including floods in the case of safaris), warlike events, unrest, strikes, etc. However, TTS will endeavour to inform you as quickly as possible in such cases and offer you an alternative solution.
6.3 Costs due to unforeseen changes during planning
If TTS has to change a trip that you have already paid for, resulting in an objective reduction in value compared to the originally agreed service, you will receive a refund from TTS. However, if additional costs are incurred after the conclusion of the travel contract for a reason mentioned in section 4.2 or 5.2, you may be subject to a price increase. If this amounts to more than 10% of the originally agreed travel price, you have the right to withdraw from the contract within 5 days of receiving our notification. Without your written cancellation within 5 days, the price increase is deemed to have been accepted. In the event of cancellation, your deposit will be refunded less a lump sum for expenses of a maximum of 10% of the package price.
7 If there are any difficulties during your travel arrangements
7.1 Complaints during the trip
If you have cause for complaint during the trip, you must notify the local representative or the relevant service provider immediately. This is a necessary prerequisite for the subsequent assertion of any claims for compensation and also enables us to remedy the situation in most cases.
If your intervention does not lead to an appropriate solution, you are obliged to request a written confirmation from our representative or the service provider stating your complaint and its content. No claims for compensation can be asserted or recognised on site.
7.2 Premature termination or changes during the trip by you
If you have to terminate the trip prematurely for any reason or wish to change services, TTS is generally not obliged to make any refunds.
In the event that you have to terminate the trip prematurely for an urgent reason (e.g. your own illness or accident, serious illness or death of relatives, etc.), TTS or our local representative will assist you as far as possible in organizing your return journey or in making changes.
TSS cannot assume any additional costs incurred. When taking out travel insurance (see sections 11.1 and 11.2), we recommend that you include return travel insurance.
7.3 Refunds
If you wish to make justified claims in the event of complaints (see point 7.1), your request for compensation and confirmation from our representative at the destination or the service provider must be submitted to TTS in writing within 4 weeks of the end of your trip at the latest. If you do not comply with these conditions, any claim for compensation will lapse.
8 Passport, visas, vaccinations and insurance
8.1 At www.twendetanzania.ch you will find information on the passport and visa requirements as well as the health formalities that must be observed for the trip and the stay, as at the time of booking.
TTS will notify you of any changes that become known at a later date before the start of the trip and will inform you of the deadlines for obtaining the necessary documents.
8.2 TTS accepts no liability for refusal of entry due to visas not being obtained or not received. Each travel participant is solely responsible for compliance with the prescribed passport, visa, customs, foreign exchange and health regulations.
8.3 TTS expressly recommends taking out travel insurance that covers the points not included in the liability (9).
9 Liability
9.1 General information
TTS undertakes to provide the travel arrangement selected by you with all necessary services in accordance with the invitation to tender within the framework of these travel and contractual conditions.
9.2 Limitations and exclusions of liability
Our liability is limited, as far as permissible, to a total of twice the travel price and only covers direct damage.
TTS accepts no liability if program changes have to be made as a result of flight delays or strikes. TTS is also not liable for program changes that are due to force majeure (including floods in the case of safari trips or bad weather conditions in the case of trekking), official orders or delays by third parties for which we are not responsible.
9.3 International agreements and national laws
If international agreements or national laws contain limitations or exclusions for damages resulting from non-performance or improper performance of the contract, these limitations are deemed to be exclusions for the liability of TTS. International agreements and national laws with limitations and exclusions of liability exist in particular in the transportation sector (such as air transport, shipping on the high seas and rail transport). Any further liability on the part of TTS is excluded in these cases.
9.4 Excursions, events, sports activities etc. booked on site
During your trip, it is possible to book additional excursions, sightseeing tours, events and sports activities individually. Please note that TTS only acts as an agent for local organizers. Their terms and conditions apply exclusively.
TTS can therefore accept no liability for excursions, events, sports activities and sightseeing etc. that you book during your stay in Tanzania.
9.5 Accidents and illnesses, pregnancy
TTS accepts liability for direct damage in the event of death, physical injury or illness during the trip, provided that this was culpably caused by us or a company commissioned by us (hotels etc.).
In the event of pregnancy, you are obliged to inform the organizer before booking and to enquire about the transport conditions of the airlines and shipping companies. TTS can help you with this.
If you are denied transportation/embarkation due to pregnancy, any liability will be rejected. As a rule, shipping companies no longer accept pregnant women after the 25th week.
9.6 Damage to property
TTS accepts no liability for theft or loss during a trip with TTS. TTS recommends taking out luggage insurance.
9.7 Statute of limitations
Claims against TTS expire within one year of the contractual end of the trip. Shorter or mandatory longer limitation periods based on the applicable national and international law remain reserved.
10 Flights and luggage within Tanzania
10.1 Baggage and sports equipment
As a rule, your free baggage allowance for domestic flights with local airlines is limited to 1 piece of baggage weighing a maximum of 15 kg per person. Most airlines charge for the 2nd piece of baggage.
Please also note the local regulations of the airport regarding carrying liquids in hand baggage.
The transportation of excess baggage and sports equipment is possible on most domestic flights, but only with advance notification and for a fee.
In most cases, a separate or larger means of transport must be organized for the transport of sports equipment (surfboard, bicycle) from the airport to the hotel and back. For this reason, advance booking is also essential. The additional transportation costs will be collected on site.
10.2 Electronic flight ticket/E-ticket
For flights with airlines that offer electronic tickets, TTS will only issue e-tickets. The flight ticket is stored in the airline’s reservation system and check-in program. The passenger only needs to identify himself/herself with a passport or identity card at check-in.
10.3 Delays
Even with careful travel organization, we cannot guarantee that timetables will be adhered to. Delays can occur as a result of heavy traffic, traffic jams, accidents, airport congestion, detour, delays in border clearance, etc.
11 Insurance
11.1 Cancellation insurance
Cancellation insurance is recommended at the time of booking.
11.2 Supplementary insurance / travel assistance
Experience shows that sudden incidents can quickly present travelers with unexpected difficulties. TTS therefore recommends taking out comprehensive travel insurance.
If you fall ill or have an accident during your vacation, this will organize the search and rescue, transport to a hospital in your destination country or transport back to Switzerland.
It is also highly recommended that you take out luggage insurance. It covers the costs you incur if your luggage is stolen, damaged or destroyed.
12 Data protection
12.1 Collection and storage of information
The protection of privacy and personal data is of great importance to TTS. TTS complies with the provisions of Swiss data protection legislation when collecting and using personal data.
In addition to your contact details, the following information is also stored when you make a booking: travel dates, itinerary/destination, airline, hotel, price, customer preferences, information about your fellow travelers, payment information, date of birth, nationality, language, preferences, etc., as well as other information that you provide to TTS. In special circumstances (e.g. accident during your trip, etc.) and in the event of complaints, further information may be obtained and stored.
12.2 Disclosure to third parties
In compliance with data protection regulations, your data may be passed on to third parties who use it in the context of a contractual relationship for TTS, whereby data may also be transferred abroad.
Your data may be passed on to cooperation partners and used by these companies to the same extent as it is used by TTS, i.e. as is necessary for business transactions or required by applicable law and in particular by the competent authorities – or as the data is necessary to safeguard or enforce the legitimate interests of TTS.
With your booking, you declare your express consent to the processing of particularly sensitive personal data for the purpose of business processing by TTS.
TTS does not pass on any personal data outside of business transactions without your consent (e.g. sales / brokerage etc.).
13 Applicable law and place of jurisdiction
The place of jurisdiction for any disputes is Lucerne. Swiss law applies exclusively.
