1. General Terms and Conditions of Travel and Contract

These ‘General Terms and Conditions of Travel and Contract’ apply to all travellers who have booked their trip with Twende Tanzania Safari (TTS). They form an integral part of the contract between you and TTS.

2. Conclusion of contract

2.1 The contract between you and TTS is concluded upon signing the contract document. From this point on, the rights and obligations arising from the contract (including these ‘General Terms and Conditions’) become effective for you and TTS. If the person making the booking registers additional travellers, they are responsible for their contractual obligations (in particular payment of the travel price) as well as for their own obligations. The contractual agreements and these ‘General Terms and Conditions’ apply to all travellers.

2.2 When making your booking, you are obliged to provide your name and the names of your fellow travellers as they appear on the identity documents used for the trip (passport, etc.). If the names on the travel documents do not match the names on the identity documents, you may be refused travel services or incur costs for the reissue of tickets. TTS cannot cover the costs incurred in this case.

2.3 Please note that our services only apply from the airport in Tanzania. You are responsible for your own flights to and from Tanzania. It is therefore your responsibility to arrive at the airport in Tanzania on time. TTS cannot accept any liability for changes made by airlines (flight schedules, travel costs, etc.). TTS is also not a contractual partner for any other arrangements booked by the travellers themselves or directly.

2.4 If TTS arranges individual travel (ancillary) services from third-party providers (e.g. hotels, domestic airlines, etc.) and/or travel arrangements from other tour operators or shipping companies, the respective travel and contract conditions of the third-party providers shall apply.

3. Provisional reservations and bookings

3.1 TTS does not accept provisional reservations or bookings.

4. Terms of payment and prices

4.1 Due date

A deposit of 40% of the travel price is due upon conclusion of the contract. The remaining payment is due 40 days before the planned departure.

If the contract is concluded less than 40 days before the planned departure date, the entire travel price is due for payment upon conclusion of the contract.

4.2 Price increases

For certain cases listed below, we reserve the right to increase the prices quoted retrospectively, even after conclusion of the contract, in the event of:

– Tariff changes by transport companies (e.g. fuel surcharges)

– Newly introduced or increased generally binding fees or charges (e.g. increased port or airport taxes or increased parking fees)

– price increases imposed by the government (e.g. value added tax)

– extraordinary price increases by hotels

– plausibly explainable printing errors

– exchange rate changes

4.3 Exchange rates

The prices of travel arrangements are calculated at the exchange rates prevailing at the time of the non-binding offer.

4.4 Withdrawal
If TTS has to increase the prices quoted for the reasons mentioned above, you will be notified of this price increase no later than 3 weeks before departure. If the price increase exceeds 10% of the originally booked package price, you have the right to withdraw from the contract within 5 days of receiving our notification. In this case, TTS will refund you in accordance with section 6.3.

5. Cancellation, change or non-arrival on your part

5.1 General
Cancellations or changes must be made in writing.
If the FDFA and/or the FOPH advise against travelling to a region you have booked, you can change your booking within a certain period. No cancellation fees will be charged, but processing fees and insurance premiums may be charged.
TTS adheres exclusively to the travel advice issued by the FDFA or FOPH. If these authorities do not expressly advise against travelling to your booked country or region, the following conditions apply:

5.2 Processing fees
TTS charges a processing fee of CHF 100 per person for cancellations and changes (name changes, changes to travel dates, rebooking of accommodation).
Any telephone charges will be added to this. For boat trips, safaris and guided treks, additional shipping company and agency fees may apply. Once the cancellation period has begun, the conditions set out in section 5.3 also apply.

5.3 Costs of cancellation/change
If you withdraw from the contract later than the number of days specified below before the start of your trip, we will charge the following costs as a percentage of the package price in addition to the processing fees specified in section 5.2, whereby 100% of the package price will not be exceeded.
– 90-45 days before departure 25%
– 44-30 days before departure 50%
– 29-0 days before departure, including no-shows 100%

5.4 Replacement person
If you are unable to travel, you may propose a replacement person for yourself under the following conditions. Please note, however, that we can only register your replacement person if all our travel partners still allow this change at the time of registration. In addition, the following points apply:
– The replacement person is willing to take over your travel arrangement under the same conditions that you have agreed with us.
– The other companies involved in your trip (hotels or airlines and shipping companies) accept this change, which can be difficult, especially in the high season.
– The replacement person meets the special travel requirements (passport, visa, vaccination regulations).
– There are no legal or official restrictions preventing your replacement from participating in the trip.
– This person and you are jointly and severally liable to us or the booking office for the payment of the price and for any additional costs incurred as a result of this transfer.

5.5 Failure to commence the trip
If a passenger does not commence the trip arranged by TTS, 100% of the trip price must be paid in any case and the obligation to transport the passenger shall lapse. This also applies in the event of flight schedule changes. TTS recommends confirming the return flight to Switzerland with the relevant representative 72 hours before departure.

5.6 Joint and several liability
Participants in a TTS trip are jointly and severally liable for the total travel costs, regardless of who is named as the signatory in the travel agreement or contract.

6. Programme changes, cancellation or non-performance of the trip by TTS

6.1 Unforeseen changes before the trip
If it is not possible to carry out a trip as promised or agreed with you, TTS will endeavour to find a replacement solution without assuming any liability for its success. This will be done in such a way that the objective purpose or character of the trip can be maintained as far as possible.

6.2 Unforeseen changes during planning
TTS reserves the right, also in your interest, to change programmes or individual agreed services (e.g. accommodation, mode of transport, aircraft type, airline, excursions) if unforeseen circumstances so require.
TTS reserves the right to replace a named airline with another airline for domestic flights organised by the company. You will be notified of the name of the new airline as soon as possible.
In rare cases, TTS may also be forced to cancel your trip for reasons beyond our control, whether for your safety or due to other compelling circumstances, such as non-granting or withdrawal of landing rights, force majeure (including flooding in the case of safaris), acts of war, unrest, strikes, etc.
However, TTS will endeavour to inform you as soon as possible in such cases and offer you an alternative solution.

6.3 Costs due to unforeseen changes during planning
If TTS has to change a trip that you have already paid for, resulting in an objective reduction in value compared to the originally agreed service, you will receive a refund from TTS. However, if additional costs arise after the conclusion of the travel contract for a reason mentioned in sections 4.2 or 5.2, you may be subject to a price increase. If this exceeds 10% of the originally agreed travel price, you have the right to withdraw from the contract within 5 days of receiving our notification. Without your written declaration of withdrawal within 5 days, the price increase shall be deemed accepted. In the event of withdrawal, you will receive your deposit back minus a flat-rate fee of maximum 10% of the package price.

7. If difficulties arise during your travel package

7.1 Complaints during the trip
If you have any cause for complaint during the trip, you must report this immediately to the local representative or the relevant service provider. This is a necessary prerequisite for any subsequent claims for compensation and also enables remedial action to be taken in most cases.
If your intervention does not lead to an appropriate solution, you are obliged to notify TTS of the complaint in writing or in text form (electronically) as soon as possible. No claims for damages can be asserted or recognised on site.

7.2 Premature termination or changes during the trip by you
If you have to terminate the trip prematurely for any reason or wish to change any services, TTS is generally not obliged to provide a refund.
In the event that you have to terminate the trip prematurely for an urgent reason (e.g. your own illness or accident, serious illness or death of relatives, etc.), TTS or our local representative will assist you as far as possible in organising your return journey or in making any changes you wish to make.

TSS cannot cover any additional costs incurred. When taking out travel insurance (see sections 11.1 and 11.2), we recommend that you include return travel insurance.

7.3 Refunds
If you wish to make a justified claim in the event of complaints (see point 7.1), your claim for compensation and confirmation from our representative at the destination or the service provider must be submitted to TTS in writing within four weeks of the end of your trip at the latest. If you do not comply with these conditions, any claims for compensation shall lapse.

8. Passports, visas, vaccinations and insurance

8.1 At www.twendetanzania.ch you will find information on passport and visa requirements as well as health formalities that must be observed for the trip and stay, as applicable at the time of booking.
TTS will inform you of any changes that become known after the start of the trip and will notify you of the deadlines for obtaining the necessary documents.

8.2 TTS accepts no liability for refusal of entry due to visas not being obtained or not being received. Each participant is solely responsible for complying with the prescribed passport, visa, customs, foreign exchange and health regulations.

8.3 TTS expressly recommends taking out travel insurance that covers the points not included in liability (9).

9. Liability

9.1 General information
TTS undertakes to arrange the travel package you have selected with all the necessary services as advertised in accordance with these travel and contract conditions.

9.2 Limitations and exclusions of liability
Our liability is limited, to the extent permitted, to a total of twice the travel price and covers only direct damage.
TTS accepts no liability if programme changes are necessary as a result of flight delays or strikes. Likewise, TTS is not liable for programme changes due to force majeure (including flooding in the case of safari trips or bad weather conditions in the case of trekking), official orders or delays caused by third parties for which we are not responsible. In the event of unforeseen and unavoidable events or force majeure, such as war, strikes, natural disasters, withdrawal of land rights, epidemics, pandemics and associated official measures, the scope of services is limited. In such cases, the service descriptions are not binding. In the event of limited service provision in the event of such unforeseen and unavoidable events or force majeure, you are not entitled to a refund of the travel price. Further claims for damages are rejected.

9.3 International agreements and national laws
If international agreements or national laws contain restrictions or exclusions for damages resulting from non-performance or incorrect performance of a contract, these restrictions shall apply as exclusions for the liability of TTS.
International agreements and national laws with limitations of liability and exclusions of liability exist in particular in the transport sector (such as air transport, shipping on the high seas and rail transport). Any further liability on the part of TTS is excluded in these cases.

9.4 Excursions, events, sports activities, etc. booked locally
During your trip, it is possible to book additional excursions, sightseeing tours, events and sports activities individually. Please note that TTS acts solely as an agent for local organisers in this regard. Their terms and conditions apply exclusively.
TTS therefore cannot accept any liability for excursions, events, sports activities, sightseeing tours, etc. that you book during your stay in Tanzania.

9.5 Accidents and illnesses, pregnancy
TTS accepts liability for direct damage in the event of death, physical injury or illness during the trip, provided that this was caused by us or a company commissioned by us (hotels, etc.).
In the event of pregnancy, you are obliged to inform the organiser before booking and to enquire about the transport conditions of the airlines and shipping companies. TTS can assist you with this.
If you are refused transport/embarkation as a result of pregnancy, any liability is rejected. As a rule, shipping companies do not accept pregnant women after the 25th week.

9.6 Damage to property
TTS accepts no liability for theft or loss during a trip with TTS. TTS recommends that you take out luggage insurance.

9.7 Limitation period
The statutory limitation periods apply.

10. Flights and baggage within Tanzania

10.1 Luggage and sports equipment
As a rule, your free baggage allowance on domestic flights with local airlines is limited to one piece of luggage weighing no more than 15 kg per person. Most airlines charge for a second piece of luggage.
Please also note the local airport regulations regarding liquids in hand luggage.

On most domestic flights, excess baggage and sports equipment can be transported, but only if notified in advance and for a fee.
In most cases, a separate or larger means of transport must be organised to transport the sports equipment you have brought with you (surfboard, bicycle) from the airport to the hotel and back. For this reason, advance notification is also essential. The additional transport costs will be collected on site.

10.2 Electronic flight ticket/e-ticket
For flights with airlines that offer electronic tickets, TTS issues e-tickets exclusively. The flight ticket is stored in the airlines’ reservation system and check-in programme. The traveller simply identifies themselves with their passport or identity card at check-in.

10.3 Delays
Even with careful travel planning, we cannot guarantee that timetables will be adhered to. Delays may occur as a result of heavy traffic, traffic jams, accidents, airport congestion, diversions, delayed border clearance, etc.

11. Insurance

11.1 Cancellation insurance
We recommend that you take out cancellation insurance when booking.

11.2 Additional insurance / travel assistance
Experience shows that sudden incidents can quickly present travellers with unexpected difficulties. TTS therefore recommends that you take out comprehensive travel insurance.

If you fall ill or have an accident during your holiday, this insurance will organise the search and rescue, transport to a hospital in your destination country or transport back to the United Kingdom.
We also highly recommend taking out luggage insurance. This covers costs incurred in the event of theft, damage or destruction of your luggage.

12. Data protection

12.1 Collection and storage of information
TTS attaches great importance to the protection of privacy and personal data. TTS complies with the provisions of Swiss data protection legislation when collecting and using personal data.
In addition to your contact details, the following information is also stored when you make a booking: travel dates, itinerary/destination, airline, hotel, price, customer requests, information about your fellow travellers, payment information, date of birth, nationality, language, preferences, passport copy, emergency address in Switzerland, allergies, etc., as well as other

information that you provide to TTS. In special circumstances (e.g. accident during your trip, etc.) and in the event of complaints, further information may be obtained and stored.

Personal data will only be stored by TTS for as long as is necessary to fulfil our contractual and legal obligations (in particular storage obligations) or otherwise for the purposes pursued with the processing.

12.2 Purposes and legal basis
The purposes and legal basis for processing are the fulfilment of the contract with you and the fulfilment of legal obligations.

12.3 Disclosure to third parties
Your data will be disclosed to third parties who use it for TTS within the framework of a contractual relationship in compliance with data protection regulations, which may also involve data transfer abroad. Your personal data may be processed in countries and on servers outside Switzerland. Consequently, your personal data may be transferred to countries that do not have a level of data protection comparable to that in Switzerland and therefore do not have an adequate level of data protection.
Your data may be passed on to cooperation partners and used by these companies to the same extent as TTS uses it, i.e. as necessary for business transactions or as required by applicable law and in particular by the competent authorities – or as necessary to safeguard or enforce the legitimate interests of TTS.
To obtain a current list of the cooperation partners used, you can contact us at any time.
By making a booking, you expressly consent to the processing of particularly sensitive personal data for the purpose of business transactions by TTS.
Outside of business transactions, TTS does not pass on any personal data without consent (e.g. sale/brokerage, etc.).

12.4. Your rights
You may request information about the processing of your personal data at any time. You also have the right to have the personal data processed about you corrected, deleted or restricted. If data processing is based on your consent, you may revoke this consent at any time with future effect. The lawfulness of the data processing carried out up to the point of revocation is not affected by any revocation.
We will comply with these requests, subject to compliance with statutory retention obligations or other regulations.
You also have the option of lodging a complaint about data processing with the supervisory authority. For Switzerland, this is the Federal Data Protection and Information Commissioner (www.edoeb.admin.ch).

13. Final provisions

13.1. Applicable law and place of jurisdiction
The exclusive place of jurisdiction for any disputes is Lucerne. Swiss law applies exclusively.

13.2. Ineffectiveness of a provision
Should any provision of this agreement be invalid or unenforceable, or should this agreement contain a loophole, this shall not affect the validity and enforceability of the remaining provisions of the agreement. The invalid or unenforceable provision or loophole shall be replaced by a valid and enforceable provision that, in the opinion of the parties, comes closest to the economic objective of the invalid or unenforceable provision.
